Shady Springs PSD fails to pay settlement agreement, suit claims

BECKLEY -- Justice Holdings seeks to enforce a settlement agreement after the defendant has failed to pay.

Justice Holdings LLC filed a lawsuit on Dec. 20 in Raleigh Circuit Court  against Shady Springs Public Service District, citing breach of contract and unjust enrichment.

The plaintiff states in November 2007, a settlement was reached between Cooper Land, which was acquired by the plaintiff, and the defendant. Cooper Land has fully performed under the settlement agreement, but since Dec. 31, 2010, Shady Springs has refused to pay money due under the agreement, according to the complaint.

Justice Holdings is seeking compensatory damages, interest, fees and costs. The plaintiff is being represented in the case by Martin J. Glasser and Sang Ah Koh of Lewis Glasser Casey and Rollins PLLC.
