BECKLEY -- A woman is suing a grocery store after running into a wooden pallet.
Polly Mullins filed a lawsuit Dec. 18 in Raleigh Circuit Court against The Kroger Co., citing negligence and negligent and/or intentional spoliation of evidence.
According to the complaint, on Dec. 26, 2011, Mullins was a customer at the Kroger located at 1734 Harper Road in Beckley. Mullins says she was walking by a wooden pallet when she bumped into the pallet. She states the pallet punctured her right leg and caused her to fall and break her right hip and arm.
Mullins is seeking an undisclosed amount of damages plus punitive damages. She is being represented in the case by attorney Stephen P. New and Amanda J. Gardner.
