New London Commons Development sued for defective construction

WINFIELD -- A couple are suing their home's building contractor after shingles continue falling off of roof.

Lloyd A. Casto and Loretta A. Casto filed a lawsuit Dec. 30 in the Circuit Court of Putnam County against AB Contracting Inc., New London Commons Development Inc. and Ben Vest, citing negligence.

According to the complaint, in January 2004 the plaintiffs purchased a home from New London Commons located at 1022 Wethersfield Crossing, Lot 27, Hurricane. The plaintiffs say since purchasing the house they have had four separate instances of shingles detaching from the roof and exposing it to the elements, causing them to have the roof repaired each time. They state that in early 2013 they filed a claim with their homeowners insurance who had a engineer inspect the roof, at which time the engineer concluded that the cause of the shingles detaching was faulty and defective construction in the installation of the roofing shingles.

The Castos are seeking an undisclosed amount of damages. They are being represented in the case by attorneys Richard E. Holtzapfel and David A. Holtzapfel.
