Former employee sues W.Va. Northern Community College

Wvncc

WHEELING -- A student disability coordinator is suing after unexplained termination from employment at a community college.

Denise Wycherley filed a lawsuit Jan. 2 in the Ohio County Circuit Court against West Virginia Northern Community College, citing tort of outrage and unlawful retaliation.

According to the complaint, Wycherley had been a sign language instructor since 1998 and the Student Disability Coordinator since 2006 at WVNCC, receiving favorable evaluations and multiple salary raises.

Wycherley says she advised the school several times, from October 2011 to April 2012, against parts of its student Health Sciences application that were in violation of disability discrimination laws. According to the lawsuit, the school failed to act, leading to a student filing an Americans with Disabilities Act complaint against the school in October 2012, a month before the same student nominated Wycherley for an award relating to her support in opposing disability discrimination.

According to the lawsuit, the school again failed to respond to the complaint, and when Wycherley was scheduled to assist an Americans with Disabilities Act coordinator, Wycherley's employment at WVNCC was terminated.

Wycherley is seeking an award of past and future lost wages. She is being represented in the case by attorney Sandra K. Law of Schrader Byrd & Companion PLLC.
