BECKLEY -- A couple is suing Discover for alleged illegal debt collection attempts.
Derek Lilly and Opal Lilly filed a lawsuit Jan. 7 in Raleigh Circuit Court against Discover Bank Inc., citing violations of the West Virginia Consumer Credit and Protection Act, the Computer Crime and Abuse Act, the Telephone Harassment Statute, intentional infliction of emotional distress and invasion of privacy.
The complaint alleges the plaintiffs were indebted to the defendant and the defendant began to engage in collection through the use of telephone calls and other communications, in violation of West Virginia statutes.
The Lillys are seeking an undisclosed amount of damages, plus court costs. They are being represented by Paul W. Roop II of Roop Law Office LC.
