Man sues Discover for debt collection attempts

BECKLEY -- A man is suing Discover for alleged illegal debt collection attempts.

Clarence Whitlow filed a lawsuit Jan. 7 in the Raleigh County Circuit Court against Discover Bank Inc., citing violations of the West Virginia Consumer Credit and Protection Act, the Computer Crime and Abuse Act, the Telephone Harassment Statute, intentional infliction of emotional distress and invasion of privacy.

The complaint alleges the plaintiff was indebted to the defendant and the defendant began to engage in collection through the use of telephone calls and other communications, in violation of West Virginia statutes.

Whitlow is seeking an undisclosed amount of damages, plus court costs. He is being represented by Paul W. Roop II of Roop Law Office LC.

Raleigh County Circuit Court Civil Action No. 14-C-11-H.
