Putnam couple sues under lemon law

CHARLESTON -- A Putnam County couple is suing an automobile manufacturer and a dealer because their vehicle doesn't work.

Roger and Diana Rhodes filed a lawsuit Jan. 8 in Kanawha Circuit Court against Kia Motors America Inc., Hometown Preowned Vehicles Inc. and Americredit Financial Services Inc., claiming they violated the “lemon law,” breached warranties, fraud and committed unfair and deceptive acts or practices.

The suit states the couple bought a 2012 Kia Optima from Hometown Preowned Vehicles on Jan. 6, 2012. They said the vehicle had multiple problems and has been in the shop at least eight times. The couple claims work at Hometown Preowned Vehicles wasn’t up to standards to repair the vehicle and the vehicle has manufacturing flaws preventing it from being repaired.

The couple is seeking $200 in actual costs and damages to be determined at trial, plus court costs. They are being represented by Kristina Thomas Whiteaker of The Grubb Law Group.
