CHARLESTON -- A Foster woman is suing a medical device company after her heart defibrillator was recalled.
Shelby Whitman filed a lawsuit Jan. 8 in Kanawha Circuit Court against St. Jude Medical Inc., claiming its product caused her increased medical needs, expense and suffering.
The complaint states Whitman had a surgery to implant the device on Feb. 25, 2006, and received a written notice of the recall on Jan. 12, 2012, from West University Physicians of Charleston. She underwent a second procedure on Feb. 22, 2013, at Charleston Area Medical Center to replace the device, the suit states.
Whitman is seeking damages that will fairly compensate her for her injuries, plus court costs and pre-judgment interest on special damages. She is being represented by Donald Wandling of Avis, Witten & Wandling L.C.
