Raleigh woman sues Capital One over collection methods

BECKLEY -- A woman is suing over improper debt collection efforts by a bank.


Cheryl Hope Kessler filed a lawsuit Jan. 10 in Raleigh Circuit Court against Capital One Bank N.A., citing violations of the consumer credit and protection act, computer crime and abuse act a violation of the telephone harassment statute, intentional infliction of emotional distress, and invasion of privacy.

The complaint states Kessler became indebted to the defendant at which time the defendant began to engage in collection of the debt by the use of telephone calls and written communication, in violation of state statutes.

The plaintiff is seeking damages no greater than $75,000. Attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nelson are representing her in the case.
