CLARKSBURG -- A man has filed a federal lawsuit claiming his former employee fired him because of his service as a member of the U.S. Air Force Reserve.
Clarence Triplett filed his suit Jan. 16 in U.S. District Court for the Northern District of West Virginia, naming Edison Mission Operation and Maintenance as the sole defendant.
Triplett claims he was employed by Edison since 2006 until his employment was terminated in March 2011. Triplett accuses Edison of treating him unfairly because of his duties as a reservist. In February 2011, Triplett claims he missed multiple days of work because of illness, then on March 1, 2011, he was fired for his absences.
Triplett says he was fired because of his military status and is suing under the Uniform Services Employment and Reemployment Act. Triplett is seeking an undisclosed amount in damages. He is being represented by attorney Drew M. Capuder.
