Company wants paid for work done at coal mine

MADISON -- A company is suing, seeking payment for services rendered at a coal mining site.


Virco Inc. filed its lawsuit Jan. 2 in Boone Circuit Court against Eagle Mining LLC and Shepard Boone Coal Co. LLC, seeking enforcement of a mechanic's lien and breach of contract.

According to the complaint, Shepard Boone Coal owned a property where Eagle Mining was engaged in coal mining activities in Boone County. Virco says they provided excavation and land clearing at the site of the mining for a price of $80,220 and the defendants have failed to pay the amount due for the work. Virco claims they served notice of a mechanic's lien to the defendants on Nov. 13, but are still owed the total amount for the services.

Virco Inc. is seeking damages in the amount of $80,220, plus interest, costs and attorney's fees. Attorney Scott H. Kaminski of Balgo & Kaminski LC is representing the plaintiff in the case.
