Oceana says apartment complex hasn't paid garbage fees

PINEVILLE -- The Town of Oceana is suing for violation of a city ordinance.


The town filed a lawsuit on Jan. 16 in Wyoming Circuit Court against Oceana Apartments Ltd., citing violation of city ordinance and seeks an injunction.

The complaint says the defendant has failed to pay the town of Oceana for garbage collection and removal services, resulting in an unpaid balance of $13,799.49. Oceana states their city council voted unanimously to discontinue refuse service to the defendant until the bill was paid. Oceana Apartments then violated city ordinance by hiring citizens to pick up garbage and drive to the landfill to dispose of the refuse, according to the complaint. The plaintiff contends the defendant has been warned their actions are in violation of city ordinance.

Oceana is seeking actual damages, including the unpaid garbage bill, punitive damages, a restraining order and costs. The plaintiff is being represented by Lela Walker.
