WHEELING – A chemical manufacturer wants a Marshall County case filed against it moved to federal court.
Michael J. McGovern originally filed his lawsuit against PPG on Dec. 13 in Marshall Circuit Court. He worked for PPG at its Natrium Plant in Marshall County.
In his complaint, filed by Wheeling attorney Teresa Toriseva of Toriseva Law, McGovern says he was working a repackaging line on Dec. 23, 2011, placing lids on 25-gallon buckets of Calcium Hypochrorite when he was injured by repetitive motion and a trauma caused by a known hazardous conveyor belt packaging line process.
McGovern says his injuries were the result of unsafe working conditions at PPG.
As a result of PPG’s actions, McGovern says he was injured and forced to miss work, resulting in lost wages and benefits.
In its removal notice filed Jan. 16, PPG says the case should be in federal court because it believes McGovern seeks more than $75,000 in damages even though no dollar amount is mentioned in the original complaint.
PPG is being represented by Wheeling attorneys William D. Wilmoth and Christopher A. Lauderman of Steptoe & Johnson PLLC.
The case has been assigned in federal court to District Judge Frederick P. Stamp.
