Couple says company caused damage to their home

CHARLESTON -- A couple is suing after they allege a home improvement company caused damage to their property.


Philip and Linda Thornton filed a lawsuit Jan. 16 in the Kanawha County Circuit Court against Victorian Development LLC and Rodney L. Jordon.

According to the complaint, on Aug. 29, Philip and Linda Thornton hired Victorian Development, owned by Jordon, to do home improvements on their home in Elkview. The plaintiffs say Victorian Development performed substandard work, causing damage to the Thorntons' property. The defendants are accused of breach of express warranties, breach of implied warranty of merchantability, breach of implied warranty of fitness, common law fraud and misrepresentation, negligence, unfair or deceptive acts or practices and breach of contract.

Philip and Linda Thornton are seeking an amount in damages to be determined by the court. They are being represented in the case by attorneys Cameron S. McKinney and David L. Grubb of The Grubb Law Group.
