Psychologist sues state board of examiners after probation

CHARLESTON -- A psychologist is suing after state board of examiners imposes unfair probation.



Fred Jay Krieg Ph.D., filed a lawsuit Jan. 17 in Kanawha Circuit Court against the state of West Virginia Board of Examiners of Psychologists and Jeffrey Harlow, citing malicious prosecution and defamation.

According to the complaint, on June 3, 2011, the West Virginia Board of Examiners of Psychologists imposed fines and probation upon school psychologist Dr. Krieg based upon accusations of code violations in a 2007 assessment of a child regarding special education opportunities. According to the lawsuit, the decision was then overturned by the Honorable Jennifer F. Bailey on May 17, finding that Dr. Krieg had not committed any code violations in the 2007 assessment.

The West Virginia Board of Examiners of Psychologists and Harlow, the executive director of the board, are accused of malicious prosecution and defamation.

Dr. Krieg is seeking lost earnings and damages in an ammount to be determined by the court, plus costs. He is being represented in the case by attorneys Harry P. Waddell and David M. Hammer.
