Former employee says Waste Management discriminated against him

CHARLESTON -- A Kanawha County man is suing a former employer, claiming discrimination due to age and disability.


Michael Legg filed a lawsuit Jan. 14 in the Kanawha Circuit Court against Doug Hall and Waste Management of West Virginia Inc., citing perceived disability and discrimination.

Legg alleges in the suit that on April 9, he suffered a heart attack while employed by the defendant in Kanawha County. According to the suit, Legg returned to work after receiving doctor's approval. Legg received multiple write-ups after returning to work, complaining of Legg not wearing his reflective vest while at work and also allowing workers to smoke in the defendant's equipment. Legg claims the defendant is discriminating based on Legg's age and disability caused from his heart attack.

Legg is seeking damages, interest, reinstatement costs, attorney's fees and court costs. He is being represented in the case by Charleston attorney Lia DiTrapano Fairless of DiTrapano Law Firm PC.
