Putnam man claims Discover used illegal collection practices

WINFIELD -- A man is suing Discover for alleged illegal debt collection attempts.


Patrick Nee filed a lawsuit Jan. 24 in Putnam Circuit Court against Discover Bank, citing violations of the West Virginia Consumer Credit and Protection Act, negligence, intentional infliction of emotional distress and invasion of privacy.

The complaint alleges the plaintiff was indebted to the defendant and the defendant began to engage in collection through the use of telephone calls and other communications in violation of West Virginia statutes.

Nee is seeking an undisclosed amount of damages, plus court costs and attorney's fees. He is being represented by Benjamin Sheridan and Mitchell Lee Klein of Klein, Sheridan & Glazer LC. The case has been assigned to Circuit Judge Phillip M. Stowers.
