Insurer says Dollar General fire damaged adjacent business

KINGWOOD -- An insurance company is suing after a business was damaged by a fire.


Motorists Mutual Insurance Co., as subrogee of Christine Croucher, doing business as Rainbow Tire, filed a lawsuit Jan. 16 in Preston Circuit Court against Dollar General Corporation, Dolgencorp LLC, Howard Berger Co. Inc. and Atico International USA Inc.

According to the complaint, on Jan. 18, 2012, a fire damaged Croucher's business, Rainbow Tire, and her insurance company, Motorists Mutual, made payments totaling more than $140,000.

The plaintiff says it was determined the fire was caused by a space heater fan manufactured, supplied and sold by the defendants, who are accused of negligence, strict liability and breach of warranty.

Motorists Mutual is seeking more than $140,000 in damages. It is being represented in the case by attorneys Charles R. Steele of Steele Law Offices and T. David Higgins Jr. of Cozen O'Connor. The case has been assigned to Circuit Judge Lawrance S. Miller.
