Man accuses Raleigh Co. PSD of age discrimination

BECKLEY -- A manager is suing his former employer, alleging he was fired because he was old.


Barry Clyburn filed a lawsuit Jan. 29 in Raleigh Circuit Court against Raleigh County Public Service District, citing labor violations.

The lawsuit states Clyburn had been a general manager with his employer for 19 years and consistently performed duties meeting expectations. He was terminated April 8, and Clyburn claims it was because of his age. Clyburn is claiming human rights violations, hostile work environment, wrongful discharge, intentional and negligent infliction of emotional distress and violation of public policy.

Clyburn is seeking damages that will fairly compensate him, pre-judgment and post-judgment interest, punitive damages and court costs. He is being represented by J.B. Akers of Akers Law Offices PLLC. The case has been assigned to Circuit Judge John A. Hutchison.
