LOGAN -- A woman's estate is seeking payment of insurance benefits under an uninsured motorist coverage.
Wanda Thompson, as administratrix of the Estate of Deea Workman, deceased, filed a lawsuit Feb. 10 in the Logan Circuit Court against State Farm Mutual Automobile Insurance Co., citing breach of contract and unfair trade practices.
According to the complaint, on Dec. 5, 2010, Workman was traveling as a passenger with Jefferson Fox in his Ford Explorer on Accoville Road. The complaint states an accident in which the Ford Explorer slid over the embankment in the road.
According to the complaint, Fox left the scene on foot to seek assistance leaving behind Workman who was injured in the crash. The complaint states when Fox returned to the scene of the accident the next day with associate Mark Cantrell, they discovered Workman's dead body a few feet from the vehicle.
The complaint states it was determined that Workman died of hypothermia. The complaint further states that Fox has also died, but not as a result of the crash.
According to the complaint, Workman's estate filed a wrongful death lawsuit against Fox as a result of the crash. The complaint states the Ford Explorer was uninsured and the court ordered State Farm to pay uninsured benefits under the policy. The complaint alleges State Farm has failed to respond to the plaintiff's settlement demand or pay any benefits under the plan.
The estate is seeking an undisclosed amount of damages. They are being represented by Larry O. Ford and Sean W. Cook of Meyer, Ford, Glasser & Radman PLLC. The case has been assigned to Circuit Judge Roger L. Perry.
