Hancock Co. woman wants order qualifying deed

NEW CUMBERLAND -- A Hancock County woman is suing seeking an order declaring a deed is satisfied.


Donna J. Elo filed a lawsuit in Feb. 5 in Hancock Circuit Court against Major Mortgage and Market Street Mortgage Corp.

The complaint states on Oct. 13, 2000, the plaintiff executed a Deed of Trust on her property in Hancock County that was eventually assigned to the defendants. Elo claims despite having received the full balance due under the loan and Deed of Trust, the defendants have failed to execute a release. As a result, the property remains encumbered by the October 2000 Deed of Trust, according to the complaint.

Elo is seeking an order stating the deed held by the defendants has been satisfied.

The plaintiff is being represented in the case by Weirton attorneys Kevin M. Pearl and Jordan C. Hettrich of Frankovitch, Anetakis, Colantonio & Simon. The case has been assigned to Circuit Judge Ronald E. Wilson.
