Woman accuses banks of unlawful collection practices

BECKLEY -- A West Virginia woman is suing over claims debt collectors used unlawful means to contact her.


Sherri Kirk, also known as Sherri McCorey, filed a lawsuit Feb. 10 in Raleigh Circuit Court against GE Capital Retail Bank, Mercantile Adjustment Bureau LLC and Equable Ascent Financial LLC, citing the West Virginia Consumer Credit and Protection Act.

According to the complaint, after the plaintiff became in arrears upon alleged indebtedness to the defendants, she retained an attorney and informed the defendants as such when they called her residence. The plaintiff says the defendants continued to place calls, intentionally inflicting emotional distress and constituting invasion of privacy. The defendants are also accused of common law negligence.

Kirk is seeking no more than $75,000 in damages.

She is being represented in the case by attorney Brian R. Blickenstaff of Turner & Johns PLLC.
