WINFIELD -- A woman is suing a debt collector on allegations the company violated collection laws.
Edith Young filed a lawsuit Feb. 10 in Putnam Circuit Court against LTD Financial Services L.P., citing violations of West Virginia’s Consumer Credit and Protection Act, common law negligence, intentional infliction of emotional distress and common law invasion of privacy.
The lawsuit states Young began receiving telephone calls from the collection company regarding her debt. She advised the company she had an attorney and provided the company employee with her attorney’s contact information, according to the complaint.
Yet, she says she continued receiving numerous telephone calls in attempts to collect the debt.
Young is seeking damages to the maximum allowed for violation of the consumer protection law, other general damages and punitive damages as the court deems fit, cancellation of her debt and court costs.
She is being represented by Benjamin Sheridan of Klein, Sheridan & Glazer L.C. The case has been assigned to Circuit Judge Joseph Reeder.
