Two families sue Capital One over debt claims

BECKLEY -- Two West Virginia families are suing over claims Capital One Bank used unlawful debt collection means.


Jerryd and Amanda Clyburn and Ronald and Brenda Reed filed lawsuits Feb. 7 in Raleigh Circuit Court against Capital One Bank, USA, NA, citing violations of the West Virginia Consumer Credit and Protection Act.

According to the complaint, Capital One placed harassing phone calls to the homes of the plaintiffs and used other unlawful means of debt collection, intentionally inflicting emotional distress and constituting invasion of privacy.

The plaintiffs are seeking damages less than $75,000. The Clyburns and the Reeds are being represented in the case by attorney Paul W. Roop II.
