Contractor says coal companies didn't pay

PINEVILLE -- A West Virginia contractor is suing over claims it was not paid for services conducted.


Vecellio & Grogan Inc. filed a lawsuit Feb. 6 in Wyoming Circuit Court against National Resources Inc., Bluestone Coal Coporation, Mechel Bluestone Inc. and Pocahontas Land Corporation, citing contract violations.

According to the complaint, on March 27, V&G entered into a contract with the defendants to perform overburden removal on a project for National Resources and Bluestone on property owned by Pocahontas Land Corporation in return for payment. V&G says they never received the $609,610 owed them. The defendants are accused of breach of contract and unjust enrichment.

Vecellio & Grogan is seeking the $609,610 owed, plus interest and fees.

They are being represented in the case by attorneys Norman T. Daniels Jr. and Ryan M. Hathcock of Daniels Law Firm PLLC. The case has been assigned to Circuit Judge Warren R. McGraw.
