Ohio law firm accused of debt collection harassment

BECKLEY -- A Raleigh County man is suing a debt collector, claiming harassment.


Robert L. Higginbotham filed a lawsuit Feb. 14 in Raleigh Circuit Court against the Cleveland, Ohio-based law firm of Javitch, Block and Rathbone LLC, citing violations of Consumer Credit and Protection Act, Computer Crime and Abuse Act and Telephone Harassment Statute, as well as infliction of emotional distress and invasion of privacy.

Higginbotham claims he received multiple phone calls from the defendant in order to annoy and harass him into paying debts he owed the defendant. According to the claim, the defendant tried to collect the debts due in ways which are in direct violation of several laws put into place in the state of West Virginia.

Higginbotham is seeking damages, attorney's fees and court costs. He is being represented by Fayetteville attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young and Pollard PLLC. The case has been assigned to Circuit Judge John A. Hutchison.
