WINFIELD -- A man is suing a collection company over alleged violations in debt collection.
Ricky Henderson filed a lawsuit Feb. 10 in Putnam Circuit Court against Accounts Receivable Management Inc., citing violations of the West Virginia Consumer Credit and Protection Act, common law negligence, intentional infliction of emotional distress and common law invasion of privacy.
The lawsuit states Henderson received telephone calls from Accounts Receivable to collect a debt. He informed them he was represented by an attorney and provided them with his attorney’s contact information. Yet, the company continued to call him.
Henderson is seeking actual damages for the violations, statutory damages in the maximum amount, general damages for negligence, court costs, general and punitive damages, that his debt be cancelled, and other relief the court deems proper. Henderson also had filed a proposed protective order to keep certain information confidential during proceedings. Henderson has filed at least two similar suits in Putnam Circuit Court in the last year.
He is being represented by Benjamin Sheridan of Klein, Sheridan & Glazer. The case has been assigned to Circuit Judge Joseph Reeder.
