Putnam man sues creditor over calls

WINFIELD -- A Putnam County resident is suing a collection company over alleged violations in debt collection.

Patrick Nee filed a lawsuit Feb. 10 in Putnam Circuit Court against GE Capital Retail Bank, citing violations of the West Virginia Consumer Credit and Protection Act, common law negligence, intentional infliction of emotional distress and common law invasion of privacy.

The lawsuit states Nee received telephone calls from GE Capital to collect a debt. He informed them he was represented by an attorney and provided them with his attorney’s contact information. Yet, the company continued to call him.

Nee is seeking actual damages for the violations, statutory damages in the maximum amount, general damages for negligence, court costs, general and punitive damages, that his debt be cancelled and other relief the court deems proper. Nee had also filed a summons ordering the company to answer the suit within 30 days by sending their answer to Nee’s attorney and also filed proposed protective order to keep certain information confidential during proceedings.

He is being represented by Benjamin Sheridan of Klein, Sheridan & Glazer Inc. The case has been assigned to Circuit Judge Phillip M. Stowers.
