Man sues couple after Milton accident

HUNTINGTON -- A man is suing after he was injured in a car crash.


Michael Todd Childers filed a lawsuit Feb. 19 in Cabell Circuit Court against Ashley N. Finley and David K. Finley, citing negligence per se, negligence and negligent entrustment.

According to the complaint, on Jan. 22, Childers was driving a 2001 Subaru Forester, traveling southbound on Morris Memorial Road in Milton. The complaint says at the same time the defendant, Ashley Finley, was driving a 2011 Ford Fiesta on James River Turnpike when she failed to yield the right-of-way, attempted to turn right onto Morris Memorial Road and collided into the front of Childers' vehicle.

The complaint alleges Finley attempted to flee the scene of the accident, but Childers pursued her and contacted 911.

Childers is seeking a jury trial, an undisclosed amount of damages, court costs and other relief the court deems proper. He is being represented by Thomas E. Scarr and Jason D. Bowles of Jenkins Fenstermaker PLLC. The case has been assigned to Circuit Judge Christopher D. Chiles.
