HUNTINGTON -- A Cabell County man is suing a hospital and doctor after they fail to alert him to x-ray findings of two surgical staples left in his foot.
Jackie R. Jeffery filed a lawsuit Feb. 19 in Cabell Circuit Court against David A. Denning, M.D., and The Center for Wound Healing Cabell Huntington Hospital, citing medical negligence.
According to the complaint, Jeffery had surgery in 2008 performed by Denning on his left heel. The complaint alleges Denning was negligent in failing to recognize two surgical staples had been left in the heel. The complaint further alleges Denning failed to advise the plaintiff in March 2010 that an x-ray of his left foot revealed the two staples and he also failed to remove the staples after they were identified.
The complaint states Denning failed to consider the staples might be the cause to Jeffery's continuing and recurrent infections and skin breakdowns on his left foot. Jeffrey says in January 2012 he became aware of the staples after another x-ray and had to undergo further medical procedures to remove and treat his foot.
Jeffery is seeking damages in excess of the jurisdictional limit. He is being represented by Robert P. Welsh of The Masters Law Firm LC. The case has been assigned to Circuit Judge Christopher D. Chiles.
