HUNTINGTON – A Cabell County couple has filed a lawsuit against Walmart after their daughter was hit in the head by a display sign.
Christina and Gregory Jones filed their complaint Feb. 5 in Cabell Circuit Court against Wal-Mart Stores Inc. as parents of Sierra Jones, a minor under 18.
The complaint states that Sierra Jones was a patron at Walmart in Burlington, Ohio, on Oct. 17, 2013, when she was struck in the head by a sign that fell, causing injuries.
The parents claim Walmart had a duty of care to keep the premises in a reasonable safe condition. However, they allege Walmart failed to provide and maintain adequate lighting; to keep walkways free and clear of hazards; to exercise reasonable care; to warn of such conditions; to properly supervise; to allow employees to create such conditions; and to properly secure signs.
The complaint says that as a result of the falling sign, Sierra Jones suffered injuries that have caused and will continue to cause physical and mental pain and suffering, annoyance and inconvenience, pain and discomfort as well as permanent injuries and may require additional medical services and treatment.
The parents say they have incurred medical and travel expenses and will have more in the future.
They seek compensatory damages as well as pre- and post-judgment interest and court costs.
