WHEELING -- A Kanawha County man is suing over claims he was injured by a faulty coal mine machine.
Brian Burgess filed a lawsuit Feb. 19 in Ohio Circuit Court against Alliance Resources Partners LP, Alliance Coal LLC, Tunnel Ridge LLC, doing business as Tunnel Ridge Mine, and J.H. Fletcher & Co.
According to the complaint, on April 9, 2012, Burgess was employed by Meigs Mine Service at Tunnel Ridge LLC, a coal mine owned and operated by the defendants, when his hand was crushed by a roof bolter machine manufactured by J.H. Fletcher & Co. that had the controls backward.
The defendants are accused of negligence, and J.H. Fletcher & Co. is accused of negligent design, manufacture, distribution and strict product liability.
Burgess is seeking damages in excess of the jursidictional limits.
He is being represented in the case by attorneys Stephen P. New and Amanda J. Gardner. The case has been assigned to Circuit Judge James P. Mazzone.
