Texas trio accuses coal companies of discrimination

PINEVILLE -- Three Texas men are suing over claims they were denied employment based upon their disabilities.


Jennings Saunders, Danny Daniels and Steven Adams filed lawsuits Feb. 18 in Wyoming Circuit Court against Mechel Bluestone Inc. and Dynamic Energy Inc.

According to the complaint, at various times in 2012, each of the plaintiffs applied to open coal miner positions with Mechel Bluestone and Dynamic Energy and were informed they would be hired, only to then be subjected to physical examinations and denied employment. The plaintiffs say each of them is "disabled" within the meaning of the West Virginia Human Rights Act.

Saunders, Daniels and Adams are being represented in the cases by attorneys Mark A. Atkinson, Paul L. Frampton Jr. and John-Mark Atkinson of Atkinson & Polak PLLC.
