HUNTINGTON -- A Cabell County couple is suing three Ohio residents after a car accident.
Pamela Kay Smith and James Roger Smith filed a lawsuit Feb. 14 in Cabell Circuit Court against Gallipolis, Ohio, residents Jaymes D. Haggerty, David Haggerty and Terry Haggerty, citing negligence and loss of companionship.
The plaintiffs claim on Feb. 17, 2012, Pamela Kay Smith was traveling east on U.S. 60 at the intersection of the Interstate 64 on-ramp in Barboursville, when the defendant crashed into her vehicle. According to the claim, the defendant failed to yield the right of way when it collided with the plaintiffs' car, severely injuring plaintiff Pamela Kay Smith to such extent she had to be transported from the crash scene to the hospital in an ambulance.
The plaintiffs are seeking damages, attorney's fees, interest and court costs.
They are being represented by Huntington attorney J. Roger Smith II of Law Offices of J. Roger Smith II. It is unclear from the complaint if the attorney is related to the plaintiffs in the case.
