HUNTINGTON -- A Cabell County woman is suing a taxi company for negligence.

Hortense Barber filed a lawsuit Feb. 18 in Cabell Circuit Court against Metro Tristate Inc., citing negligence.

Barber claims on July 5, the taxi driver she requested to pick her up from her residence, in Huntington, failed to help her get into the taxicab, resulting in Barber falling. According to the claim, Barber is older than 75 years of age and requires assistance, but the taxicab driver sat in the car while Barber walked on her own toward the cab.

The suit claims he got out of the cab after she fell to call for an ambulance and then left Barber with her neighbors. As a result of the fall, Barber fractured her hip and had to undergo surgery to replace the ball of the hip joint.

Barber is seeking damages and medical expenses.

She is being represented by Huntington attorney Michael C. Walker of Cyrus and Adkins.
