Nursing assistant says co-workers made up stories about her

LOGAN -- A certified nursing assistant is suing the long-term care facility that employed her and other staff on allegations they fabricated a story about her to hurt her career.



Eshukii Tolliver filed a lawsuit Feb. 20 in Logan Circuit Court against Genesis Healthcare L.L.C., doing business as The Logan Center, Kristain Chafin C.N.A., Ashley Williams Epperhart C.N.A. and Jennifer Dawn Hatfield C.N.A., citing slander, libel and malicious prosecution.

The lawsuit states an incident allegedly occurring on Jan. 21, 2011, involving Tolliver was reported and was processed through the internal system. Tolliver was accused of using threatening and cursing words toward Chafin in front of a resident in the resident’s room, according to the complaint.

Tolliver claims the incident never happened, yet her name was put on a list of abusive health care workers. A hearing examiner ruled in Tolliver’s favor in an appeal.

Tolliver is seeking the court to award damages to adequately compensate her, punitive damages, plus interest and court costs.

She is being represented by Kendal E. Partlow of Blair Law Offices. The case has been assigned to Circuit Judge Roger L. Perry.
