Subcontractor says it didn't get paid

MOUNDSVILLE -- A subcontractor is suing the contractor after not being reimbursed for additional electrical wiring.


Erb Electric Company filed a lawsuit Feb. 19 in Marshall Circuit Court against Honeywell International Inc., citing failure to pay a bill.

The lawsuit states Erb entered into a subcontract agreement with Honeywell on April 25, 2011, to complete the electrical wiring in the new Cameron High School Complex. Honeywell requested additional work costing $8,253. Erb submitted a payment voucher and was denied payment because the purchase order was no longer valid, the complaint said.

Erb is seeking a judgement of $8,253, plus pre-judgment interest and court costs.

It is represented by Ronald Musser of Spilman, Thomas & Battle PLLC. The case has been assigned to Circuit Court Judge David W. Hummel.
