SUMMERSVILLE -- A Nicholas County couple is suing a loan company to have a structure built partially on their land removed.
Bradley and Marsha Hughart filed a lawsuit on Feb. 19 in Nicholas Circuit Court against Quicken Loans, citing criminal trespass and asking for ejectment and damages.
The lawsuit states the Hugharts own land next to property once owned by relatives. In the past 10 years, a house was constructed on the land and the land was sold in 2011 as part of a trustee sale. The Hugharts discovered in 2012 that a portion of the structure is on their property, the complaint states.
The Hugharts are seeking removal of the structure on their property and the property be returned to its original condition, plus damages, which could include punitive damages and court costs.
