Kanawha parent files suit after student was assaulted

CHARLESTON -- A Kanawha County parent is suing the Kanawha County Board of Education after a student was assaulted.


Heather S. King, individually and as parent and guardian of SLC, a minor, filed a lawsuit Jan. 30 in Kanawha Circuit Court against Alma Smith and the Kanawha County Board of Education, citing battery, assault, intentional infliction of emotional distress and negligence.

The complaint states on April 10, SLC was a student at East Bank Middle School when Smith physically assaulted the minor. It is unclear from the complaint what Smith's role at EBMS was.

According to the complaint, East Bank Middle School failed to limit Smith's access to students.

The plaintiff is seeking damages, attorney's fees and court costs.

King is being represented by Scott S. Segal, Samuel A. Hrko and Victor S. Woods of The Segal Law Firm. The case has been assigned to Circuit Judge Louis H. "Duke" Bloom.
