CHARLESTON -- Kanawha residents are suing alleging Lowe's failed to honor an extended warranty.
Ernest G. Hentschel II and Becky Hentschel filed a lawsuit Jan. 31 in Kanawha Circuit Court against Lowe's Home Centers LLC.
The complaint states in August 2012, the plaintiffs visited the defendant's store in South Charleston, and purchased a Whirlpool Gold Refrigerator with extended warranty/service care plan. The plaintiffs state when purchasing the extended warranty, it was represented to them that if Lowe's or the manufacturer could not repair the refrigerator after three attempts, it would be replaced.
In October 2012 and January 2013, the plaintiffs contacted Lowe's after they discovered their refrigerator had stopped cooling, according to the complaint. The plaintiffs contend three unsuccessful attempts to repair the refrigerator have been made, but Lowe's refuses to replace the plaintiffs' refrigerator as required under the terms of the extended warranty.
The plaintiffs are seeking specific performance, compensatory damages, punitive damages, costs and fees.
They are being represented by Sara A. Jones of Kesner & Kesner PLLC. The case has been assigned to Circuit Judge James C. Stucky.
