Putnam Co. man says he was hit by 50-foot pipe at mine

CHARLESTON -- A Putnam County man is suing over claims he was injured at a surface mine.


Charles M. Shirkey filed a lawsuit Jan. 29 in Kanawha Circuit Court against Central Contracting Inc. and Hobet Mining LLC, citing negligence.

According to the complaint, on April 4, 2012, Shirkey was employed by All Crane and Equipment Rental Corporation as a laborer and truck driver at Hobet's No. 21 surface mine when he was struck by a 50 foot-long pipe. Shirkey says Hobet and Central employees were moving the pipe with a Komatsu excavator owned by Central when the accident occurred.

The defendants are accused of negligence and providing an unsafe workplace. Shirkey is seeking more than $50,000 in damages.

He is being represented in the case by attorney J. Kristofer Cormany. The case has been assigned to Circuit Judge Charles E. King.
