CHARLESTON -- A Kanawha County man is suing over claims he was discriminated against by an employer based on his age.
Bradley D. Ullum filed a lawsuit Feb. 21 in Kanawha Circuit Court against Patriot Coal Corp., Speed Mining LLC, Coal Clean LLC, Melvin Smith and Gary Burroughs, citing age discrimination.
According to the complaint, after 11 years employment for Patriot Coal, Ullum experienced age discrimination, with his supervisors Smith and Burroughs passing him over for younger workers, and, eventually, constructive discharge. Ullum says he was deemed "insubordinate" after reporting safety violations the company committed.
Ullum is seeking damages to be detemined by the court, including back pay and court costs.
He is being represented in the case by attorney John Einreinhofer. The case has been assigned to Circuit Judge James C. Stucky.
