Woman says Frontier wrongly fired her

CHARLESTON -- An employee is suing her former company after she was allegedly fired without cause.


Deena McClelland filed a lawsuit Feb. 5 in Kanawha Circuit Court against Frontier West Virginia, citing wrongful firing, failure to accommodate disability, and violation of the Wage Payment and Collection Act.

The lawsuit states McClelland was employed by Frontier in March 2000 and became a residential customer service clerk in September 2009. She had from 2000 on, suffered from severe debilitating migraines, which forced her to miss work in January 2013. She was suspended without pay Feb. 5, 2013, and discharged Feb. 26, 2013, the complaint states.

McClelland is seeking compensatory and punitive damages, plus any other relief of the court.

She is being represented by Lonnie C. Simmons of DiTrapano, Barrett, Dipiero, McGinley & Simmons P.L.L.C. The case has been assigned to Circuit Judge Tod J. Kaufman.
