Woman says mortgage holder breached contract

BERKLEY -- A Raleigh County woman is suing a financial lending company, claiming breach of contract.


Angela M. Pannell filed a lawsuit Feb. 28 in Raleigh Circuit Court against Green Tree Servicing LLC, citing breach of contract, unlawful debt collection and violation of Consumer Credit Act.

Pannell alleges in the suit in March 2008 she got a mortgage loan for the property in Beckley, which she paid monthly payments on until the middle of 2013. The suit alleges Pannell fell behind on her regular mortgage payments, and modified the loan with the defendant for her to keep her home. According to the brief, Pannell met the requirements of the modification, but the defendant breached the contract and hired a law firm to evict Pannell from her home and take possession of the property.

Pannell is seeking damages, civil penalties for each violation, attorney's fees, court costs and other relief as the court deems just.

Pannell is being represented in the case by Beckley attorney Anthony M. Salvatore, of Hewitt and Salvatore PLLC. The case has been assigned to District Judge Robert A. Burnside.
