Woman says debt wasn't hers

BECKLEY -- A woman who was the victim of identity theft is suing a credit card company for trying to collect on debt she never owed.


Katherine Dallman Grubb filed a lawsuit Feb. 28 in Raleigh Circuit Court against GE Capital Retail, citing credit collection violations, invasion of privacy and negligence.

The lawsuit states GE Capital issued a credit card in Grubb’s name to someone else. She obtained an attorney when she realized her identity had been stolen and gave her attorney’s contact information to GE Capital collectors when they called for payments, the complaint said. Yet, collectors continued to call, the complaint said.

Grubb is seeking up to a maximum of $75,000 in damages.

She is being represented by Kristina Thomas Whiteaker of the Grubb Law Group.
