BECKLEY -- A former pizza worker filed a lawsuit against his two former employers, citing wrongful termination and human rights violations.
Stanley Jarvis filed a lawsuit March 7 in Raleigh Circuit Court against Sugar Creek Pizza L.L.C. and New River Pizza L.L.C., citing they violated numerous employee protection laws.
The lawsuit states Jarvis worked for Pizza Hut through 1988 and then became an employee for Midland Food Services. He began to suffer knee problems in 2012 which were attributable to work, but Midland supervisors told him not to file workers' compensation but to use his medical insurance to pay for treatment, the complaint said.
Afterward, Jarvis was subjected to harassment at work with his supervisor telling him he is now a liability and others making racist remarks regarding Jarvis’ in-laws. Jarvis also said he, and others, were required to participate in a scheme where the businesses greatly inflated their losses after a storm and also learned one supervisor wasn’t property reporting and paying royalties on concession vans. Jarvis was terminated shortly afterward, the complaint said.
Jarvis is seeking damages including lost wages and benefits, back pay, front pay, damages for embarrassment, humiliation, annoyance, inconvenience and emotional distress, punitive damages, pre and post judgment interest, injunctive relief and court costs.
He is being represented by Gregory B. Chiartas of Freeman & Chiartas. The case has been assigned to Circuit Judge Robert A. Burnside.
