Man says debt collector illegally charged him fees

CHARLESTON -- A construction worker is suing after a debt collector wrongfully charged fees.


David S. Black filed a lawsuit March 7 in Kanawha Circuit Court against Santander Consumer USA Inc., citing illegal late fees, illegal default fees and refusal to apply payments.

The complaint states around September 2010, Santander became a debt collector for the plaintiff's auto loan. The plaintiff says the defendant wrongfully charged the plaintiff late fees, default fees and other unauthorized fees. In addition, Santander only accepted payment methods that incurred significant fees, according to the complaint.

The plaintiff is seeking $4,725 for each statute violation, fees and costs.

Black is being represented by Jennifer S. Wagner of Mountain State Justice Inc. The case has been assigned to Circuit Judge James C. Stucky.
