Man says prosthetics company caused pain, suffering

WHEELING -- A West Virginia man is suing a prosthetics company on claims their product caused him pain and suffering.


James Buckner filed a lawsuit March 4 in the Northern District of West Virginia against Depuy Orthopaedics Inc., citing negligence.

According to the complaint, Depuy Orthopaedics developed and marketed a hip replacement joint in 2001 that was advertised as an ideal therapy for active adults. Less than two years after manufacture, adequate evidence became available to the defendant the design was flawed and needed to be recalled. However, it was not until 2010 the defendant decided to recall the product, causing unnecessary suffering to numerous patients who trusted the marketing and advice of doctors.

Buckner is seeking an unspecified amount in damages for medical expenses, lost wages, pain and suffering and lawyers' costs.

He is being represented in the case by attorney Lee W. Davis of the Law Offices of Lee W. Davis, Esquire P.L.L.C.
