WHEELING -- A Marshall County man is suing the deputy commissioner of Marshall County and others for fraud and negligence.
Harry W. Moore filed a lawsuit on March 11 in the United States District Court for the Northern District of West Virginia against Robert W. Kagler, Marshall County Commission; Hayhurst Company; Ronald Hayhurst; Chestnut Holding Inc. and the state of West Virginia, citing denial of U.S. Constitutional due process protection, mail fraud, wire fraud, conspiracy, racketeering and negligence.
Moore claims as a result of the deputy commissioner, defendant Kagler's, actions his property was taken away without notice. The suit alleges the defendants Hayhurst and Kagler didn't inform Moore that he was delinquent on his property taxes, resulting in the sale of the property to Tri-County Oil and Gas. According to the brief, the property had deposits of oil and gas the defendants wanted so they devised the scheme of stealing the land which is worth between $4,302,841.80 and $7,171,403.
Moore is seeking the return of his property, damages in the amount of $16,000,000, interest, attorney fees and court costs.
He is being represented in the case by Hinton attorney Jenny A. Bonham.
