CHARLESTON -- A truck driver is suing a distribution company after he was laid off following a knee injury at work.
Ronald Mark Chapman filed a lawsuit March 6 in Kanawha Circuit Court against Meyer Distribution Inc. and operations manager Fred Sermersheim, citing deliberant intent to cause injury, discriminatory termination of an injured employee and retaliatory firing.
The lawsuit states Chapman worked as a truck driver for Meyer Distribution and his truck broke down July 26, 2012. He was forced to move its cargo to another truck without proper equipment and tore his medial collateral ligament in his right knee, the complaint said. When he returned to work on Dec. 18, 2012, Chapman was told there were no available positions and he was being laid off, according to the complaint.
Chapman is seeking general and specific damages, including front and back pay, punitive damages, interest on judgment, pre-judgment interest and court costs.
He is being represented by Abraham J. Saad of the Saad Law Office. The case has been assigned to Circuit Judge Louis H. Bloom.
